Creator Agreement

This Creator Agreement (“Agreement”) sets out the terms governing the relationship between FanFlaire (“we”, “us”, “our”, “the Platform”) and content creators (“Creator”, “you”, “your”).
By creating an account, uploading content, or using monetization features, you agree to comply with this Agreement.

This Agreement applies in addition to the Terms of Service and other policies posted on the Platform.

1. Eligibility and Registration

To participate as a Creator, you must:

• Be at least 18 years old

• Provide accurate, complete, and current information

• Have full legal capacity to enter into a contract

• Not be prohibited from using online services by applicable law

You are responsible for maintaining the security of your account and for all activity under it.

We may request additional information to verify identity or eligibility.

2. Content Ownership and Rights

You retain ownership of all content you upload to the Platform.

By uploading content, you grant FanFlaire a worldwide, non-exclusive, royalty-free licence to:

• Host, store, display, and distribute content on the Platform

• Promote the Platform, including using content in promotional materials

This licence applies only for the duration of hosting and ends when content is removed, except where content has already been purchased, downloaded, or otherwise accessed by users.

You represent and warrant that:

• You own the content, or have rights to use it

• The content does not violate laws or third-party rights

• The content is original and lawful

You are solely responsible for your content.

3. Content Standards and Compliance

Creators must comply with:

• Applicable laws

• Intellectual property regulations

• Platform policies and standards

• Community guidelines

Creators must not upload content that:

• Is illegal or harmful

• Incites violence or hatred

• Harasses or exploits individuals

• Violates privacy or confidentiality

• Infringes copyright or trademarks

We may review, restrict, or remove content that breaches these standards.

4. Revenue and Payments

FanFlaire enables creators to earn income from monetization features such as:

• Subscriptions

• Tips

• Digital purchases

• Other features offered by the Platform

Unless otherwise stated, revenue is shared as follows:

• Creator receives 80% of net revenue

• FanFlaire retains 20% as a service fee

Payment processing fees, chargebacks, and taxes may be deducted before calculating payouts.

5. Withdrawal of Earnings

Creators may request withdrawals when their available balance meets platform requirements.
Payouts are typically processed within a reasonable timeframe following a valid request.

To receive payments, Creators must provide accurate:

• Payment details

• Identity information

• Tax information, where required by law

FanFlaire may require Creators to complete identity verification (“KYC”) and provide tax information before enabling withdrawals.
This process may be required from the first withdrawal request, regardless of earnings.

FanFlaire may suspend withdrawals if:

• Required information is not provided

• Information is inaccurate or unverifiable

• Fraud or unlawful activity is suspected

Funds will remain in the Creator’s account balance until verification is completed.
FanFlaire is not liable for losses due to incorrect information supplied by the Creator.

Creators are solely responsible for reporting and paying taxes related to earnings received through the Platform.

6. Data Protection and Privacy

FanFlaire processes personal data in accordance with applicable laws.
Creators agree to respect user privacy and confidentiality.

Creators must not misuse personal or sensitive data obtained through the Platform.

7. Prohibited Conduct

Creators must not:

• Interfere with platform operations

• Attempt to circumvent payment systems

• Engage in fraudulent, deceptive, or unlawful activities

• Encourage others to violate laws or policies

Violation may result in account suspension, termination, or legal action.

8. Reporting and Dispute Resolution

Creators should promptly report:

• Security issues

• Policy violations

• Infringement of intellectual property

• Unlawful behaviour

We may investigate reports and take appropriate action.

9. Termination and Account Closure

You may close your account at any time.
Upon closure:

• Your licence to FanFlaire ends

• Hosted content may be removed

• Outstanding earnings may be settled

FanFlaire may suspend or terminate accounts if:

• Policies are breached

• Laws are violated

• Harmful conduct occurs

Termination does not waive obligations incurred prior to closure.

10. Intellectual Property Violations

Creators must not upload or distribute content that infringes third-party rights.

FanFlaire responds to copyright complaints in accordance with its Copyright and DMCA Policy.

Repeated infringement may result in permanent account closure.

11. Liability and Indemnification

Creator use of the Platform is at their own risk.

FanFlaire is not liable for:

• Loss of income

• Loss of content

• Platform downtime

• Claims arising from creator conduct

Creators agree to indemnify FanFlaire against claims arising from:

• Uploaded content

• Policy violations

• Unlawful activities

12. Policy Updates

FanFlaire may update this Agreement.
The updated version will be published on the Site.

Continued use of the Platform constitutes acceptance of changes.

13. Governing Law

This Agreement is governed by the laws of the United Kingdom.

Disputes may be resolved through negotiation, mediation, or legal action in relevant courts.
